This Privacy Policy describes how Til Technologies Inc. ("Hotsauce," "we," "us," or "our") collects, uses, and shares personal information when you visit our websites, interact with our marketing materials, or otherwise engage with us (collectively, the "Services"). It also explains the choices and rights you have with respect to your personal information.

1. Scope of This Policy

This Privacy Policy applies to personal information that we collect and process as a controller — that is, information we collect through our public websites, marketing activities, sales process, support interactions, and other business operations.

An important note about customer data. Our customers (typically businesses and their authorized users) use the Hotsauce platform to process data of their own, including data they upload, connect from third-party systems, or generate through the Service ("Customer Data"). When we process Customer Data, we do so as a processor on behalf of our customers under our customer agreements, including our Terms of Use and our Data Processing Addendum. The privacy practices of our customers govern how Customer Data may be collected and used within their accounts, and any questions about Customer Data should be directed to the applicable customer. This Privacy Policy does not describe how we process Customer Data.

2. Information We Collect

The categories of personal information we collect depend on how you interact with us.

Information you provide to us. We collect personal information that you provide directly, including:

  • Account and contact information, such as your name, email address, phone number, employer, job title, and mailing or business address.

  • Authentication credentials, such as your username, password, or single-sign-on identifiers.

  • Sales, support, and communications, such as information you share when you request a demo, contact our sales or support teams, respond to surveys, attend events, or otherwise correspond with us.

  • Payment and billing information, such as billing address, payment instrument details (handled by our third-party payment processors), and transaction records.

  • Job applicant information, if you apply for a position with us, such as your resume, work history, references, and any other information you provide as part of the application process.

Information we collect automatically. When you visit our websites or use the Services, we (and our service providers) may automatically collect:

  • Device and connection information, such as IP address, device identifiers, browser type and version, operating system, language preferences, and referring URLs.

  • Usage information, such as pages visited, features used, links clicked, time spent, search queries, and other interactions with the Services.

  • Approximate location information, derived from IP address or similar signals.

  • Cookie and similar technology data, as described in Section 6 below.

Information from third parties. We may receive personal information about you from third-party sources, such as business contact databases, social media platforms, event organizers, our partners, and publicly available sources. We may combine this information with information we collect directly.

3. How We Use Personal Information

We use personal information for the following purposes:

  • To provide, operate, and improve the Services, including authenticating users, maintaining accounts, providing support, debugging, performing analytics on usage, and developing new features and products.

  • To communicate with you, including responding to inquiries, sending transactional or administrative communications about your account or the Services, providing customer support, and (where permitted) sending marketing communications about Hotsauce.

  • For sales, marketing, and business development, including evaluating leads, personalizing marketing content, measuring the effectiveness of campaigns, and inviting you to events.

  • To ensure security and prevent fraud or abuse, including detecting, investigating, and responding to security incidents; protecting against fraudulent, malicious, or illegal activity; and enforcing our agreements and policies.

  • To comply with legal obligations and protect rights, including responding to lawful requests from public authorities, complying with applicable laws, and exercising or defending legal claims.

  • For other purposes with your consent, or as otherwise disclosed to you at the point of collection.

4. Artificial Intelligence

The Hotsauce platform and certain features of our websites use artificial intelligence and machine learning technologies, including models provided by third-party AI service providers. Information that you provide through our public-facing websites, marketing interactions, or other channels covered by this Privacy Policy is processed as described in this Policy. Our handling of Customer Data, including in connection with the AI components of the Service, is governed separately by our customer agreements, as described in Section 1.

5. How We Share Personal Information

We share personal information in the following circumstances:

  • Service providers and subprocessors. We share personal information with third parties that provide services on our behalf, such as cloud hosting and infrastructure providers, AI service providers, analytics providers, customer support tools, communications and email platforms, payment processors, and security and fraud prevention vendors. These parties are contractually bound to handle personal information consistent with this Policy and applicable law.

  • Affiliates. We may share personal information with our corporate affiliates for purposes consistent with this Policy.

  • Business partners. We may share personal information with business partners with whom we jointly offer products, services, or events.

  • Legal and safety purposes. We may disclose personal information when we believe in good faith that disclosure is necessary to comply with applicable law, legal process, or government requests; to enforce our agreements or policies; to protect the rights, property, or safety of Hotsauce, our users, or others; or to investigate or prevent fraud, abuse, or security incidents.

  • Business transfers. We may share personal information in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets. Personal information may be transferred as part of such a transaction.

  • With your consent or at your direction, or as otherwise disclosed to you at the time of collection.

We do not sell personal information in exchange for monetary consideration. We may, however, engage in activities that are considered a "sale" or "share" under certain U.S. state privacy laws (for example, when we use advertising or analytics cookies that share information with third parties for cross-context behavioral advertising). 6. Cookies and Similar Technologies

We and our service providers use cookies, pixel tags, web beacons, and similar technologies (collectively, "Cookies") to operate our websites, remember your preferences, analyze how the Services are used, and measure the performance of our marketing campaigns. We use the following types of Cookies:

  • Strictly necessary Cookies, which are required for the Services to function (for example, to authenticate users and maintain sessions).

  • Functional Cookies, which remember your preferences and personalize your experience.

  • Analytics and performance Cookies, which help us understand how visitors use the Services so we can improve them.

  • Marketing and advertising Cookies, which help us deliver relevant marketing to potential customers.

You can manage Cookies through your browser settings or through any cookie preference center we make available on our websites. Note that our websites do not currently respond to "Do Not Track" browser signals, but we honor the Global Privacy Control ("GPC") opt-out signal where required by applicable law.

7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. The specific retention period depends on the type of personal information, the purposes for which we use it, and applicable legal requirements. When we no longer need personal information, we delete, anonymize, or aggregate it.

8. Data Security

We seek to protect personal information from unauthorized access, use, and disclosure using appropriate administrative, technical, organizational, and physical security measures based on the type of personal information and how we process it. However, no system is completely secure, and we cannot guarantee the absolute security of personal information.

9. Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information, including the right to:

  • Access the personal information we hold about you and obtain a copy in a portable format;

  • Correct inaccurate or incomplete personal information;

  • Delete your personal information, subject to certain exceptions;

  • Opt out of the "sale" or "sharing" of personal information, targeted advertising, or certain types of profiling;

  • Restrict or object to certain processing of your personal information;

  • Withdraw consent where processing is based on your consent;

  • Appeal our decision regarding any of the foregoing requests; and

  • Lodge a complaint with a supervisory authority where you reside.

To exercise these rights, please contact us at privacy@hotsauce.com. We will respond to your request consistent with applicable law. We may need to verify your identity before fulfilling certain requests. We will not discriminate against you for exercising your privacy rights.

If you are an end user of one of our customers (for example, an employee of a business that uses Hotsauce), please direct your privacy requests to that customer in the first instance, as they are the controller of your Customer Data.

10. International Data Transfers

We are based in the United States, and we and our service providers may process personal information in the United States and other countries. These countries may have data protection laws that differ from those in your country. Where required by applicable law, we rely on appropriate safeguards (such as the European Commission's Standard Contractual Clauses) to transfer personal information internationally.

11. Children's Privacy

The Services are not directed to, and we do not knowingly collect personal information from, individuals under the age of 16. If you believe a child has provided personal information to us, please contact us at privacy@hotsauce.com and we will take steps to delete the information.

12. Third-Party Links and Services

Our websites and Services may contain links to third-party websites or services that are not operated by us. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies before providing personal information to them.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy on our website and updating the "Effective date" above, or by other means as required by applicable law. Your continued use of the Services after the effective date of an updated Privacy Policy constitutes your acceptance of the updates.
